can i just brag and say that i am sooo cool??? i notice when i’m not being my overly nice understanding self is the only time that i get what i want. well, just like with the divorce lawyer, i acted like an adult who has confidence - at least that’s what i’m able to portrait again. actually, i have an i don’t give a shit attitude now. maybe almost like a f-you type of attitude and i feel like i’m acting like a bitch. you be the judge. read my letter to my lawyer and read the one below to the commercial agent. OH maybe i just showed a “no b*ll sh*t” attitude.

i had a situation:

    when i went to look at a location for my child care center, i signed something that said that if my agent wasn’t with me during the first viewing, then s/he forfeits an agent fee. well, that very same day, the agent, DAVE that i contacted about a different property who had been really persistent in making other possible suggestions (the only agent that did that for me) became my agent. i clarified with him and told him where i stood with the other building. i want this DAVE to be there with me when i start negotiating my lease. i want the best lease possible and as it is, those leases start out benefiting the lessor. if i was to hire DAVE to consult, then i would have to pay him money. i need JOHN, the agent for the spaces that i’m interested in to waive what i signed.

i evaluated my position:

    1. i am interested in THREE spaces. that means that they don’t have to worry about spending the time to lease each individual separately if i didn’t say yes.

    2. during the tour, i asked what other types of business were looking into leasing within the complex. i told him that i wanted to know what kind of neighbors i would have. that was an open ended question that gave me insight into how well they are able to attract people. JOHN said a cooking class store wanted a space, but the building didn’t offer gas and they needed it for their gas stoves. then someone wanted to open a bar, but he doesn’t think that the city will let them in that particular space/building. and the most feasible one is a dry cleaner. i asked about the chemicals, but i guess it’s just a drop off.

      side thought: having the neighboring cooking place would’ve been good because we probably overlap in some of our target demographics. the dry cleaner … i don’t know. there’s a lot of business casual going around in my techie city. even though, we may still have an overlap. the bar would NOT be good. from what he shared, it doesn’t seem like anyone is really seriously interested.

    3. he wrote in an email that the city is almost as interested in getting those spaces filled as they are. i guess they’ve been vacant for too long and the space is expensive.

    4. i spoke with the anchor store, and they were not happy into having to buy their space. the spaces are commercial condos. i am getting a lease with the option to purchase. they also confirmed that it was expensive.

    5. i’ve moved quickly

    6. i asked myself if i can walk away if they don’t wave that form? my answer is yes. they just don’t want to spend that extra money to pay my agent

    7. if i walk away, then do i have a second choice that is almost certain? yes. my landlord said she would support me if i wanted to lease out her space. very brand new like my loft that is above it. i can just take the elevator down and i’m at work!

    8. i came in asking smart questions because i prepared for the meeting, so he knows how serious i am.

i decided that i am in the position of power, so i wrote this:

    JOHN,

    Thanks for the tour of the spaces yesterday. After careful consideration, I’ve decided that I am interested in spaces: E-F-G = 2564 sqft.

    I will leave it up to you and my agent, DAVE to start the process. Please contact him at aaaaa@bbbbbassoc.com

i just proceeded and gave him direction to work with MY AGENT.

    I will start looking into the Variance permit with the city.

you’re probably rolling your eyes, but for me, that’s a success. i’ve never used toughness to get what i want. you may not think that the way i went about the lawyer or agent were not tough, but believe me, they are for me. so does this make me “normal” like other people now?

i was pretty proud of myself when i asked my open ended probing questions to get him to talk and give me more competitive information. i really think that THAT particular SALES SKILL put me into the position of power. i was able to evaluate my position better!
